Should You Bother with the 3M Earplug Litigation?

Good question. The answer probably depends on how bad your hearing loss is and the quality of your representation.

Many people think that the ear plug litigation is a class action where all the claimants will share in one settlement. But, that is not necessarily the case.

We work with a law firm that is filing individual lawsuits on behalf of each client. The result -- --; while we can’t guarantee anything of course --; --; should be that the more severe your injuries are, the higher your award or settlement should be.

We have no way of knowing what the amount will be until actual lawsuits are filed and resolved. In addition, all cases are different, and often hard to compare.

Another answer is simply this: we are not going to spend time filing claims for which we expect small awards or settlements. It does not make any sense for us to do that.

Of course, the courts will ultimately decide how these claims are adjudicated. If the judge wants to put all the claims into one case, then the judge can do that. But at this point nothing has been decided.
